BEJAC NOTICE TO CALIFORNIA RESIDENTS

The California Consumer Privacy Act, as amended by the California Privacy Rights Act of 2020 ("CCPA"), requires us to provide California residents with a privacy policy containing a comprehensive overview of our online and offline practices regarding the collection, use, disclosure, sale, sharing, and retention of personal information, along with the rights of California residents concerning their personal information. This Notice to California Residents ("Notice") applies exclusively to California residents. If you reside outside of California, this Notice does not apply to you.

Under the CCPA, "personal information" refers to information that identifies, relates to, describes, can be associated with, or could reasonably be linked, directly or indirectly, with a particular California resident or household. Personal information excludes publicly available information, deidentified or aggregated information, or lawfully obtained, truthful information that is a matter of public concern. Throughout this Notice, we will refer to this information as "Personal Information." For current or former employees and job applicants, please refer to the California Employee Privacy Policy.

Notice at Collection of Personal Information

We currently collect and, during the 12 months before the Last Updated Date of this Notice, have collected these categories of Personal Information:

  • Identifiers (including name, alias, postal address, online identifier, Internet Protocol address, email address, account name, Social Security number, driver's license, passport number, other similar identifiers)

  • Audio, electronic, visual, thermal, olfactory, or similar information

We gather Personal Information directly from California residents and from various sources including Caterpillar Inc., business affiliates or contractors, credit reference agencies, public databases, advertising networks, internet service providers, data analytics providers, government entities, operating systems and platforms, and social networks. Not all categories of Personal Information are collected from each source.

Beyond the purposes outlined in the "HOW WE USE YOUR INFORMATION" section of our Privacy Policy, we collect and have collected the above categories of Personal Information for these business or commercial purposes:

  • Conducting audits related to ad impressions, verification of ad positioning and quality, and compliance verification
  • Maintaining security and integrity where use of Personal Information is reasonably necessary and proportionate
  • Enabling short-term, transient use, including non-personalized advertising during current interactions
  • Delivering services, including account maintenance, customer service, order processing, transaction fulfillment, customer verification, payment processing, financing, analytics, and similar services
  • Providing advertising and marketing services (excluding cross-context behavioral advertising)
  • Conducting internal research for technological development and demonstration
  • Advancing commercial or economic interests

Sale, Sharing, and Disclosure of Personal Information

While we don't "sell" Personal Information in the traditional sense of a monetary transaction, we engage in certain online activities that may constitute a sale or sharing of Personal Information under California law. These activities may include displaying advertisements on other websites and providing analytics on our Site. During the 12 months preceding this Notice's Last Updated Date, we sold or shared the following categories of Personal Information to these categories of third parties:

We disclosed Personal Information for all previously mentioned business and commercial purposes. We do not knowingly collect, sell, or share Personal Information from consumers under 16 years of age. Furthermore, we do not collect or process sensitive personal information to infer characteristics about individuals or use it for purposes beyond those permitted by CCPA regulations.

Retention of Personal Information

We maintain Personal Information for as long as necessary to fulfill the purposes for which it was collected, such as providing requested services and meeting legal, accounting, contractual, or reporting obligations.

California residents have these rights regarding their Personal Information:

For requests submitted on behalf of another California resident, please use the above method. Additional verification of your authority to act on their behalf will be required.

Request Verification Process

We verify all requests before processing them, with verification levels varying from "reasonable degree of certainty" to "reasonably high degree of certainty" based on the sensitivity of the Personal Information and potential harm risks. Verification involves confirming specific data points against our existing records.

Opting Out of Personal Information Sales or Sharing

California residents can direct us to stop selling or sharing their Personal Information through:

We do not disclose personal information obtained through our Site or Services to third parties for direct marketing purposes, thus having no obligations under California Civil Code § 1798.83.
